Realty Leasing Compliance Officer
Description

Full-time position holds responsibilities of inventory, monitoring, and compliance of land use permits, revocable permits, land leases, and rental agreements. The incumbent works in areas land record searches, title status reports, assisting with lease/permit agreement preparations, lease/permit contract compliance, including payment and collections for lease and permitted use of Tribal lands.

Responsibilities
  • Responsible for complying with federal law, Tribal ordinances, and Tribal policies and procedures.
  • Plans, develops, and implements a trust real estate services program to accomplish timely and efficient processing of applications for leasing (Commercial, Residential, Agricultural, etc.).
  • Ensures lease compliance and responds to unresolved claims in coordination with the Realty Leasing Compliance Officer, and other Tribal authorities.
  • Provide technical assistance with Tribal trust resource management/Tribal Realty Services staff in all areas of real estate management and decision-making activities.
  • Performs audits of real estate management practices, real estate transactions, and legal instrument preparation to assure conformance with legal, statutory, regulatory, and policy requirements.
  • Monitors the collection of trust funds from realty transactions, primarily lease proceeds and coordinates the maintenance and use of automated systems; i.e. Trust Asset and Accounting Management (TAAMS), and may monitor payment distributions - - If the TAAMS is found to be a meaningful and useful system for the Eastern Band of Cherokee Indians (EBCI) lease transaction monitoring since it is a Tribal nation that is based on possessory holdings.
  • Coordinates authorities to ensure timely real estate appraisals are conducted for the evaluation of transactions for lease proposals and possible condemnation actions by the Tribal Government.
  • The incumbent coordinates with and monitors the activities of the EBCI’s natural and cultural resource programs to ensure the protection, development, and utilization of the EBCI’s Trust lands are compliant with Federal and Tribal las, policies, and procedures.
  • Continually analyzes and evaluates the overall effectiveness of the Realty Leasing program and Tribal Realty Services program to initiate actions and changes that can build greater operational efficiency.
  • Renders technical advices and guidance in solving special problems or difficulties encountered throughout the program, develops and recommends methods and procedures for their elimination or adjustment.
  • Consults with program staff and formulates appropriate directives and methods to be utilized in Trust real estate management.
  • Implements operational policies, techniques and procedures deemed necessary to 1) meet program and Tribal goals and objectives; and 2) application of sound technical judgment, procedural adequacy, and the completeness of real estate transactions.
  • Plans, develops, and implements training for all functions of the Tribal Realty Services Leasing Program that includes leases, lease compliance, resolution of complaints; coordination of training related to environmental and cultural compliance, TAAMS (if applicable), and the use of personal computers to utilize the date from all information systems.
  • Conducts compliance inspections of land leases and permits to assess agriculture, home site, and commercial uses and contractual requirements.
  • Conducts home site inspections in assigned geographic areas and at the request of the Tribal Program leadership and as the need arises.
  • Initiates communication with home site lessees regarding established resident compliance issues.
  • Verifies proper uses of permitted areas for revocable permits, business leases, and home sites using digital images and review of permit language.
  • Performs map inspections and field inspections to determine lot boundaries for home sites and other authorized Tribal uses.
  • Coordinates home site inspections and tours by working through the housing authorities.
  • Communicates with customers and clients in writing, telecommunications, and in person informing them of any compliance issues.
  • Performs field investigations of trespass activities, collects information required for corrective actions, and follows through with legal actions in accordance with applicable Tribal, Federal, and State law.
  • Conducts compliance action on leased and permitted lands for violations such as trash, debris, junk vehicles, unauthorized occupancy, unauthorized use, and noncompliance with reclamation, conservation, environmental regulations, and maintenance requirements.
  • Assists with geological mapping and field work, including plotting field data and conduction quality control on data compilation.
  • Completes and maintains files on lease and permit contracts to assure proper record keeping of all contractual documents, compliance matters, corrective actions, bonding, etc.
  • Responsible for complying with federal law, Tribal ordinances, and Tribal policies and procedures.
  • Performs land record searches and data collection to prepare accurate and complete information to leases for Tribal leadership to approve.
  • Present data to the Tribal Council through the Tribal Realty Services Program.
  • Prepare accurate land descriptions for leases, survey requests, and right of way/easement agreements.
  • Prepares quarterly and annual reports for commercial, residential, and agricultural leases, summarizing activities, such as, number of modifications, number of compliance visits, collections activities taken.
  • Coordinates with other Tribal staff and Tribal Government programming on the development of new home sites, concerning locations, mapping, soils, wetlands, vegetative cover, and land use.
  • Prepares correspondence as necessary and maintains individual homes site files.
  • Mail department head communications on home sites the same day as the correspondence is signed and maintains file copy.
  • Verifies billing and forwards correction information with backup for data input.
  • Performs debt collection activities by offering payment tools, including payroll deduction, voluntary per-capita assignment and collection referral to the Tribal Court and to the U.S. Treasury.
  • Reviews standard operating procedure for collections activity annually and suggests improvements to policy and procedure.
Scope of Supervision

This position is supervised by program leadership. This position is not responsible for supervising others.

Minimum Mandatory Qualifications

Experience: Three (3) years of related experience required.

Education:Bachelor’s Degree in related field required. Equivalent combination of education and experience may be in lieu of degree, with required related experience of an additional: 5 years with a High School Diploma/GED equivalent; or 3 years with an Associate’s Degree.

Licenses & Certifications: Valid, insurable NC Driver’s License required.
