The incumbent is responsible for all management aspects of the Realty Services program, which includes financial oversight, staff development, strategic planning, and policy development. The incumbent is responsible for producing accurate recordings and file management for land records, right of ways, and other legal actions to convey and maintain property. This position directs and oversees the assignment of activities among the Realty Services staff to facilitate possessory holding activities, which includes, but is not limited to, transfers, right of ways, easements, and leases.
- Oversees the daily operations of the Realty Services program. Has direct oversight of all staff within the Realty Services program.
- Provides support services, input, and feedback to Tribal Lands Committee, and Tribal Programs or entities engaged in real property transactions and to individual Tribal citizens and the public.
- Work with the Tribal Realty Services staff, Tribal Government programs, Tribal leadership, Tribal citizens, and third parties to create, develop, and maintain a long-term (3-5 year) strategic plan for the Realty Services program. In the program plan create plans for the use of resources and systems that delivers value from data, information, and analysis of land records, historic documents, and surveys.
- Maintain a yearly strategic plan of action that can be utilized to develop budgets and departmental activity for meeting the Tribe’s mission for Realty Services. These activities shall include the use, development, and purchase of training, technology, policies, procedure, consulting, and supplies for this Tribal Division. The plan shall include methods for interactions and transactions to support leadership, committees, Tribal Programs, Tribal citizens, and third parties.
- Annual review written policy, procedures, and ordinances for the Realty Services program. Work with the Realty Services staff, Tribal Programs, leadership, Tribal committees, and third parties to improve and update the policies and procedures. The incumbent shall consult with county, state, and federal agencies to build policies and procedures that will ensure compliance for the program.
- Work with Tribal Council, Executive Branch, Bureau of Indian Affairs, and governing regulations to ensure adequate Tribal law and administrative rules and regulations are developed to maintain standards for a fair and accountable system to record official, legal, Tribal property transactions for both individual possessory holdings and Tribal trust transactions including but not limited to leasing, permitting, possessory transfers, trust and non-trust easements, mortgages, maps, plats, surveys, title reviews/reports and legal descriptions.
- Assist with land into trust applications for the Eastern Band of Cherokee Indians to the Bureau of Indian Affairs.
- Plan, organize and evaluate work assignments of all Realty Services employees, including appreciative and constructive feedback.
- Write and provide regular training and monitoring of internal operating procedures for all functions carried out by all staff.
- Makes presentations and reports to Tribal Council, Boards and Committees where expertise and responsibilities require participation including development or amendment of Tribal real property law and surveying.
- Maintains good community relations by attending Community Club Meetings and making presentations about Services provided, offering self-help forms by the Realty Services Division, and answering questions from community members.
- Maintain personnel records of the Realty Services staff including approving leave requests, over-time requests, and approving master time sheets, and Training & Travel Requests.
- Prepare, review, and carryout the initiatives of financial plans, budgets, and documents to ensure work of this division is carried out to remain compliant with timelines for performance of contracts, delivery of value to customers and contractors.
- Review and make approvals for purchases, contracts, services, and financial resources through Tribal systems, procedures, and authorizations.
- Review and make hiring recommendations, trains, evaluates, develops plans for employee improvements, and corrective actions according to Tribal policy and governing guidelines.
- Supervise the staff of Realty Services and any new programs that may complement this program or may come as addition. The staff may exceed 5 employees with as many as 4 direct reports.
- Direct or conducts highly accurate development of in-takes, research, preparation of draft transfer documents, land assignments, right of ways, quit claims, leases, title status reports, estate resolutions, life estate documentation, filing of power of attorney, guardianship, and authorizations, contracts, and processes for sale of property, homeownership documents (including Tribal long-form), land record and data information, and filing systems.
- Supervises the Realty Services staff to insure they are training and performing accurate work in development of in-takes, research, preparation of draft transfer documents, land assignments, right of ways, quit claims, leases, title status reports, estate resolutions, life estate documentation, filing of power of attorney, guardianship, and authorizations, contracts and processes for sale of property, homeownership documents (including Tribal long-form), land record and data information, and filing systems.
- Ensures the Realty Services staff is compliant and follows all Tribal policy.
- Participates in training and safety programs.
- Assists and provides back up for other personnel as required.
- Performs job duties according to established safety guidelines and Tribal policies.
- Travel for the duration of a day or multiple overnight stays for training and business meetings related to the business of Tribal Realty Services or as directed by the Executive Office.
- Enforce and adhere to policies of the Eastern Band of Cherokee Indians.
- In the event of an emergency or identified immediate need, as determined by the Principal Chief or Vice Chief, participation in preparedness and response operations will be expected. Employee may be required to fill a temporary assignment in a role different from standard duties, work hours and/or work location in preparation for, during and after the emergency/identified need. Employee may also be required to participate in relevant exercises and regular preparedness training.
This position is supervised by program leadership. This position is responsible for supervising assigned personnel.
Experience: Five (5) years of related experience required.
Education:Bachelor’s Degree in related field required. Equivalent combination of education and experience may be in lieu of degree, with required related experience of an additional: 3 years with an Associate’s Degree.
Licenses & Certifications: Valid, insurable NC Driver’s License required.
