The primary function of this position is the oversight and management of all activities and resources within the Tribal Employment Rights Office (TERO).This includes overseeing compliance of the preference laws by all Tribal programs, Tribal entities and private businesses bound by the preference as lessors of Tribal land through the Bureau of Indian Affairs (B.l.A.). The Incumbent is responsible for the overall operations of the assigned areas including services, staffing, budgeting and reporting. The Incumbent is also responsible for compliance with Federal, State and other Tribal agencies laws, policies, requirements and regulations. The Incumbent is responsible for ensuring all activities relations to the program are accomplished in such a way that the goals, programs and policies of the EBCI are implemented. This work is achieved by working with other Program Managers, Directors and Secretaries of the EBCI, including all tribal entities, TERO Vendors, federal partners and agencies, and external businesses, individuals and community.
- Responsible for budget administration and forecasting for the program including compliance with preference law which are sustained by revenue generated by the program and grants and contracts outside of the EBCI.
- Oversees handling of compliance with preference law, including violations and hearings and enforcement of sanctions; develops and implements the Workforce Development program components including referrals of the job bank, overseeing the implementation of WIOA and NEW (federal grant programs), and the Mother Town Healing Program; and, develops and implements the TERO Technical Training Institute.
- Oversees fiscal management and accountability in budget.
- Identifies potential funding alternatives and recommends program planning criteria and priorities for inclusion in the budget planning process.
- Oversees purchasing and procurement throughout section to ensure policy adherence and efficient purchasing.
- Pursues various avenues and implements methods to sustain the efficiency of the preference law throughout all Tribal entities. Pursues potential new revenue streams based on current program needs.
- Conducts interviews, hires, supervises, trains, evaluates performance, applies progressive discipline, approves merit increases, vacation schedules, etc., of subordinate staff.
- Ensures required certifications have current insurance coverage, licensing and are in good standing with procuring entities.
- Keeps the Commission informed of all goals, progress, and problems; meets with program managers to address problems and to develop plans of action; consults with the EBCI Tribal Manager - Human Resources on implementation of action plans, goal attainment and any subsequent corrective actions proposed.
- Makes work assignments to staff when the EBCI implements changes that effects the preference program.
- Reviews and implements changes in staffing, organization, planning goals, and major acquisitions of equipment, new systems, etc.
- Provides oversight and direction to staff serving on boards and committees throughout Indian Country.
- Develops and coordinates staff development programs and management training in relation to overall organizational development.
- Coordinates policy/procedure development within programs to ensure effective operations and management of resources.
- Responsible for accurate and appropriate enforcement and implementation of the EBCI Personnel Policy.
- Prepares and reviews job analysis/descriptions for positions as needed.
- Performs departmental needs assessments and reports to Commission.
- Develops and supports employee relations initiatives and morale building programs.
- Reviews and evaluates the work of staff analyses and databases, technical memoranda, staff reports, and other related documents.
- Mediates and facilitates conflict resolution between staff, also providing developmental and conflict resolution solutions and programs when needed in consultation with EBCI Tribal HR.
- Consults with staff to create goals, timetables, reporting procedures and resource allocation.
- Ensures program compliance with applicable fiscal, procurement and safety regulations.
- Recommends to the commission, identifies and prioritizes program improvements through observation and from information provided by program managers, community members, elected officials, and business groups.
- Strives to ensure balance in providing community services through meetings and outreach to inform of training opportunities.
- Oversees Tribal employees who are involved in conflict resolution with employees of other Tribal Programs, coordinates with a Legal Advisor as necessary to resolve complaints and violations of the personnel policy.
- Prepares or directs the preparation of grant applications, grant reports and project recommendations.
- Reviews and communicates project schedules and facilitates coordination with the Commission.
- Oversees contract execution and adherence to EBCI contracting policies.
- Works with Program Managers and Secretaries to facilitation problem resolution of discrimination and violation of the Preference Law.
- Provides a positive public image of the EBCI TERO through representation at meetings, forums, public appearances, events and fund-raisers.
- Provides detailed technical reports and summaries to Tribal Council on a regular basis, including project status, budget details, professional opinions, Tribal code interpretations, community reports, public safety concerns, and general information as needed.
- Responsible for compliance with all Federal, State, and local funding agencies.
- Reviews and submits reports, both project status and financial.
- Seeks funding for approved initiatives through outside sources.
- Coordinates with EBCI programs for joint projects beneficial to programs.
- Develops and coordinates community and youth education programs.
- Performs various public speaking duties to organizations, Federal agencies, States, Tribes, etc.
- In the event of an emergency or identified immediate need, as determined by the Principal Chief or Vice Chief, participation in preparedness and response operations will be expected. Employee may be required to fill a temporary assignment in a role different from standard duties, work hours and/or work location in preparation for, during and after the emergency/identified need. Employee may also be required to participate in relevant exercises and regular preparedness training.
Oversees personnel issues and provides direct supervision of upper management positions. This position is accountable to the TERO Commission. Will provide information and communication to the Commission regularly. Will be evaluated/reviewed by the Commission Chairperson based on established performance objectives, performance standards, and by evaluating performance on a periodic basis.
Experience: Five (5) years of related experience in government or business required; Five (5) years supervising or managing others; two (2) years in developing and implementing policies and procedures; and one (1) year in Grant Administration required.
Education: Masters’s Degree in Governmental Affairs, Business Management/Administration, Human Resources or related field required. Equivalent compination of education and experience may be in liew of degree, with required related experience of an additional: Three (3) years work experience with a Bachelor’s Degree.
Licenses & Certifications: Valid, insurable NC Driver’s License required. Must possess degree from an American Bar Association (ABA) accredited law school.
